EASI Terms of Use

1.0 Acceptance of Terms

1.1 By creating an account, accessing, or using the EASI application ("App") or this website, you agree to be bound by these Terms of Use ("Terms").

1.2 The App and this website are operated by eFoil Accreditation & Safety International Ltd, a company registered in England and Wales (company number ######), trading as EASI ("EASI", "we", "us").

1.3 "EASI" (eFoil Accreditation & Safety International) is a trade mark and the platform name of that company.

1.4 If you do not agree to these Terms, you must not use the App.

1.5 Transition. Until eFoil Accreditation & Safety International Ltd completes its registration, the App is operated on its behalf and these Terms take effect between you and that company automatically on its incorporation, which does not affect any right you already have.

1.6 By using the App, you represent that you are at least 18 years old (or the age of legal majority where you live), or that you have the consent of a parent or legal guardian.

2.0 Nature of the Platform

2.1 EASI is a digital platform designed to: (a) log riding sessions (b) record rider progression (c) manage equipment ("quiver") (d) connect riders, instructors, and operators

2.2 The App operates as a software platform and informational tool only.

2.3 The App does not provide real-world supervision, coaching, rescue services, or safety oversight.

2.4 No feature of the App, including rider levels, instructor designations, or operator tiers, constitutes professional advice or real-world supervision.

2.5 What EASI does, and does not do. EASI publishes safety and training standards and accredits operator businesses — schools, training centres and rental operations — against those standards. Training, and any assessment of an individual rider or instructor, is carried out by those independent operators. EASI does not train, examine or assess any individual, and does not issue certificates of competence to individuals.

2.6 Independence. EASI is a private, voluntary industry scheme. It is not accredited by, or affiliated with, the United Kingdom Accreditation Service (UKAS), holds no recognition under retained Regulation (EC) 765/2008, and is not a national accreditation body. EASI accreditation applies to operator businesses only and carries no government or UKAS status.

2.7 Any in-person training, supervision, charter, or rental service is provided solely by independent third-party operators or instructors, who are not employees, agents, or representatives of EASI unless expressly stated in a separate written agreement.

2.8 Use of the App does not create any partnership, joint venture, employment, or agency relationship between you and EASI.

3.0 User Responsibility and Assumption of Risk

3.1 You are solely responsible for: (a) your actions on the water (b) your riding decisions and safety (c) compliance with all applicable laws and regulations (d) the accuracy of any information you submit

3.2 Motorised hydrofoil and similar watersports activities involve inherent risks, including serious injury or death.

3.3 You acknowledge that you participate in such activities at your own risk and take responsibility for the risks involved. Nothing in this clause limits our liability under clause 9.2.

3.4 You agree not to rely on the App for emergency, rescue, or safety-critical decision-making.

3.5 The App does not provide medical, emergency, or rescue services, and nothing within it constitutes medical or professional safety advice.

3.6 You are responsible for keeping your account login details confidential and for activity under your account.

4.0 Warranties and Your Statutory Rights

4.1 The App and the information in it are provided on an "as is" and "as available" basis.

4.2 We do not warrant: (a) the accuracy, completeness, or timeliness of session data (b) rider levels or progression records (c) the reliability of user-submitted information (d) uninterrupted, secure, or error-free operation of the App

4.3 We do not guarantee that the App will be available at all times or that access will be uninterrupted.

4.4 Nothing in these Terms affects your statutory rights. If you are a consumer, the Consumer Rights Act 2015 gives you rights in respect of digital content and services that cannot be excluded, including that they be of satisfactory quality, fit for purpose and as described. Clauses 4.1 to 4.3 apply only so far as the law allows and do not limit those rights.

5.0 Session Logging and Data Accuracy

5.1 Session data (including duration, conditions, location, equipment used, and performance metrics) is submitted by users. A session may be confirmed by the accredited operator at whose location it took place.

5.2 EASI records what users submit and what operators confirm. EASI does not independently re-verify session data, rider history, or progression, and is not responsible for inaccuracies, omissions or misrepresentations in what is submitted or confirmed.

5.3 You are responsible for ensuring that data you submit is accurate and does not mislead others.

5.4 The App does not guarantee the accuracy of time tracking, calculations, or aggregated data derived from session logs.

6.0 Instructor, Rider, and Operator Status

6.1 Who awards what. Rider levels and instructor levels are defined in EASI's published standards. They are assessed and awarded by accredited operators, not by EASI. EASI records them and shows their status.

6.2 Operator tiers and accreditation status are determined by EASI, and apply to the operator business, not to any individual.

6.3 Designations shown in the App may not reflect governmental licensing, insurance coverage, or legally recognised qualifications.

6.4 You are responsible for independently evaluating any rider, instructor, or operator before engaging in real-world activities. Any engagement with other users is at your own discretion and risk.

6.5 EASI does not guarantee the competence, qualifications, or safety practices of any user, instructor, or operator.

7.0 Equipment, Brands, and Product Information

7.1 The App may display equipment, products, and brand information, including eFoil boards, batteries, wings, and accessories.

7.2 All product names, logos, and brands are the property of their respective owners.

7.3 EASI is not affiliated with, sponsored by, or endorsed by these brands unless expressly stated.

7.4 EASI does not guarantee product performance, safety, suitability, or compatibility.

7.5 You are responsible for following all manufacturer instructions, warnings, and recommendations.

7.6 The App uses Google Maps. By using the map, you also agree to the Google Maps/Google Earth Additional Terms of Service, and Google's Privacy Policy applies to the data Google collects when a map loads.

8.0 User Conduct

8.1 The App allows users to see one another's profiles and, where a user chooses to display it, to contact them on WhatsApp. The App has no messaging of its own.

8.2 You agree not to: (a) harass, abuse, or threaten others (b) provide false, misleading, or defamatory information (c) use the App for unlawful or harmful purposes (d) interfere with or disrupt the App or its security

8.3 You are responsible for content you submit to the App.

8.4 We may restrict, suspend, or terminate accounts and remove content where these Terms are breached or where we are required to by law. Where we do, we will tell you why unless the law prevents us.

8.5 We do not monitor all user content and do not guarantee the accuracy, integrity, or legality of user-generated content.

9.0 Limitation of Liability

9.1 Subject to clause 9.2, and to the maximum extent permitted by law, EASI and its directors, officers, employees and agents are not liable for: (a) property or equipment damage (b) loss or corruption of data (c) loss of profit, business, or opportunity (d) indirect, incidental, consequential, special, or punitive loss

arising out of or in connection with your use of or inability to use the App, your reliance on information within it, or your participation in any related activity, whether the claim is in contract, tort, negligence, breach of statutory duty or otherwise.

9.2 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence (b) fraud or fraudulent misrepresentation (c) breach of the terms implied by the Consumer Rights Act 2015 which may not be excluded (d) any other liability which cannot be excluded or limited under the law of England and Wales

9.3 If you are a consumer, we are not liable for loss that was not foreseeable at the time you accepted these Terms, or for loss arising from your use of the App for any business purpose.

9.4 If you are dissatisfied with the App, you may stop using it at any time.

10.0 Indemnification

10.1 If you use the App for business purposes, you agree to indemnify EASI and its directors, officers, employees and agents against claims, liabilities, damages, losses and reasonable expenses arising out of your use of the App, your breach of these Terms, or your participation in any related activity. This clause does not apply to consumers.

11.0 Account Termination and Changes to the App

11.1 We may suspend or terminate accounts, remove or modify content, and restrict or modify access to the App.

11.2 Where reasonably possible we will give notice before doing so, unless the law or the seriousness of a breach requires immediate action.

11.3 You may stop using the App at any time and may close your account in the App.

11.4 Some data may be retained where the law requires it or where we have a legitimate reason, as set out in the Privacy Policy.

12.0 Changes to Terms

12.1 These Terms may be updated from time to time.

12.2 We will give you reasonable notice of material changes, and you may be asked to accept updated Terms to continue using the App.

12.3 If you do not accept updated Terms, you may close your account.

13.0 Privacy and Data Use

13.1 Your use of the App is also subject to our Privacy Policy, which explains how we collect, use and protect your personal data under the UK GDPR and the Data Protection Act 2018.

14.0 Entire Agreement and Severance

14.1 These Terms are the entire agreement between you and EASI regarding use of the App and supersede any prior agreements relating to it.

14.2 If any provision is found unenforceable, the rest remains in force.

15.0 Governing Law and Jurisdiction

15.1 These Terms and any dispute arising out of them are governed by the law of England and Wales.

15.2 The courts of England and Wales have non-exclusive jurisdiction. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and you keep the benefit of any mandatory consumer protection law of that country.
